Given those things are equal, the sentencing is nearly exactly the same. It's called "precedence" and judges generally use it in order to make a decision on a punishment. Granted, I feel like there's way too much wiggle room in the court system. I've seen guys come in and get a light slap on the wrist because they come from an underserved area and have 8 kids to take care of and I've seen another guy come in for the same crime and get slammed because he was spitting on the floor and being a complete nutcase. Everything should be automated IMHO. But, that's another argument. Also, I'm very well informed and educated on the justice system. I've already done the research, lol. There's a reason blacks have more presence in prisons and it involves their environment and culture, not the mean officer that caught them committing crimes.
