@thechroniclegamer4285 yeah and sleeping soldiers are considered neither. They're not incapacitated nor unconscious, as the moment they wake up they can fight you. They're not defenseless either... or am I also not allowed to shoot at a soldier that is not aware of me?
The article you cite applies to either captured soldiers (POW), severely injured soldiers, whom are therfore incapacitated, or those rendered unconscious by enemy actions.
So in essence it applies to those that are incapable of harming you, sleeping soldiers are capable of doing so the moment they wake up. Essentially it is the same as bombing aircraft when it is still on the ground.
Not to mention, that if your definition would have been true, Russia themselves has committed this multiple times.
A point could have been made that technically you could have considered it a warcrime as the Geneva conventions state, that anyone should be given a chance to surrender. In practice this is not applied in these cases.. as stealth missions would also become impossible if you have to give everyone the chance to surrender. So no it is not a warcrime. But this actually would have some merit, but it is clear your knowledge of the conventions is quite limited.
As others have stated, militaries have a watch at night for particularly the reason, that there is a risk of attacks whilst the soldiers are asleep.
