Interesting. But surely, if the Home Office is not naming anyone then they are not prejudicing any individual case. They are making a general case that crimes have been committed and people have been arrested for those crimes. The only way that individuals' cases could be prejudiced is if the defendants actually argue that no crime took place or that they were not there. In the first argument, do you think it likely that taking part in a riot in which property is damaged, people are assaulted and threatened with death by burning could be argued not to be a crime? If the second is the case (say mistaken identity) then clearly, they would not be the "criminals" to whom the Home Office is referring.
