  2. I actually believe the Federal should be constructionist as the Constitution outlines the role and duty of the Federal government. Even a strict constructionist reading of the Constitution does not outlaw gay rights. In fact it’s liberal values and premise would defend gay rights and liberties. And any more details would be up to States. Society certainly changes and rights and liberties ever expand universally. Actual conservatives like Goldwater defended the constitutionality of gay rights and liberties. It’s regressive and religious right wing authoritarians that want to control social life. But the Constitution itself refers to the Federal government, I think we can all agree the Federal has too much power. To the point we are a unitary state instead of federalist. The federalist system is broken when States where the people want universal healthcare can’t do it.
