The charge is criminal and takes into account the wasting of the police’s, the legal firms’ and the court’s time and punishes the, “intentional malice,” behind the complaint, and the attempt to use the legal framework as your instrument for persecution.
I don’t know who brings the complaint, however. And the inherent issue that comes with it is that the police, CPS, or whomever (someone in the chain of circumstance) has to hold up their hand and say, “We went along with a complaint that we should not have entertained.” Thus, even if a private case can be brought, you are unlikely to find willing witnesses or support among the authorities, who will be admitting being made fools of, at best; possibly worse.
You would need an unambiguous, watertight case. I am out on a limb, speaking from a very limited knowledge base now, however.
But you do have my fullest agreement. I would like to see these dodgy, unethical, bullying, disreputable proto-thugs, “punished,” using the very instruments they brought to bear on their victims.
