@nuqwestr I agree with you that abortion rights should be returned to the states, like many of our current federal laws, btw, that once were under state jurisdiction. OTOH, the only way the states or federal government might constitutionally give parental rights automatically to the father is and has always been via marriage. Is the couple married at the time of conception? The husband is considered to have parental rights. Otherwise, no. (Unless the expectant mother agrees.) Otherwise, he's just the sperm donor. Sorry, but it is what it is and should be. As for consciousness, who knows when that begins, and what's the point? The Texas law makes good sense and is fair to both the mother and the baby, the two subjects most directly involved in abortion. For the first 6 weeks, the mother gets to choose. After that, the baby's rights take precedence, based on the fact that 6 weeks is the usual time at which the baby's heartbeat can be detected.
