You're right. Glenn Kirschner who was a JAG and then a Federal Prosecutor has spoken about i as others have. On the 21st the new Commander in Chief (or a head of the army) can recall him to active duty and immediately court martial him for sedition. The same can happen to ANY of the military personnel who were at the riot and broke the law. There was a Military (general/colonel) on MSNBC the day after Mike Flynn said Trump could use martial law and he not only said said that Flynn could be recalled and court martialed, but he called for that to happen. We'll have to wait and see what happens.

Actually any of the military or ex-military people involved (like Mike Flynn) can simply be recalled to active duty and court martialed. That's be expressed by a number of experts, like Glenn Kirshner who was a JAG then a Federal Prosecutor. He has a channel here on YT if you want to get a better understanding of that stuff.

@FakingANerve A lot of people are watching Glenn's channel and another one called Legal Eagle because they are simply clarifying what the law actually says rather than people screaming nonsense.

@MoKingson It will be very interesting to see what they do. But if the military have any common sense they will deal harshly with Flynn, because if you let a general get away with that what dose it tell the country?

@MoKingson When history is studied one of the great questions will be: What were the consequences of Mitch McConnell letting Donald Trump off without any accountability from the first impeachment despite overwhelming evidence?

@MoKingson What a lot of people seem to have forgotten was the great strength of the US Constitution was the system of checks and balances and the main component of that is the Senate. The president makes a nomination and their job is to check that person out and make sure they haven't put a maniac on the Supreme Court. The House passes a Law and their job is to check it out, ask questions and assure the American people it will do what it is supposed to do. Something happens and the American people want answers (good, bad or indifferent) its the Senate that holds the hearings and gets the answers. The Senate is the main check and balance, and McConnell has just weaponized it for his own ends. Chuck Schumer's REAL TASK is not getting control of the Senate its actually restoring it.

@FakingANerve Glenn Kirschner has made it pretty clear for some time of his disapproval of the Barr led DOJ. But Legal Eagle stayed off that until the Blackwater 4 pardon and then he let rip. I'm not certain what his personnel motive was but that really hit a raw nerve. And that whole Blackwater thing will have ramifications for America in the long term. The next time an American soldier or PMC clown does something stupid which country will trust America to do the right thing?
