@xzqzq Buddy there are plenty of channels where you can go and spout that garbage - THIS IS NOT ONE OF THEM. 1st: NO ONE is attempting to oust or overthrow the legally elected POTUS who at this moment is Donald Trump. No one has gone to the White House and demanded he leave or resign or anything else. A LEGALLY CONDUCTED ELECTION happened and HE LOST. 2nd: Forget Giuliani's bullshit at press conferences and mock trials. IN COURT WHERE IT MATTERS he's FAILED TO PROVE ANYTHING. 3rd: As for Michael Flynn, he has retweeted a call for martial law. That's seditious which might be hard under civilian law because of the 1st Amendment, but Flynn's ex-military and his oath to protect the Constitution still applies. He's accountable under the UCMJ and now facing a potential court martial.

But you are right - in terms of American Presidents this is uncharted territory. And this has huge effects on the entire western world. FYI - I'm Australian but went to college in America and can barely believe this is happening. You can't commit treason when you are the sitting President, BUT your followers can if they scheme against the government. As far as I know treason is when you are in the act of overthrowing the government or monarch. It was very easy for English Kings to use treason in times past because whatever they decided was treason was treason. Its very hard to charge these days UNLESS you are caught acting on behalf of a foreign government like spies do. The problem is that right at this moment Trump is still the legally elected President and Biden isn't anything. Until the Electoral College votes he's not actually the president elect. We only assume he is and that the EC will vote in good faith. For Trump to commit treason at this moment he would probably need to do something really stupid or drastic or specific that gets American civilians injured. That hasn't happened yet and we should hope it doesn't This is why accusations of sedition are easier right now because they are attacking and UNDERMINING an institution of government. Its all fair that Trump askes for recounts where its close or challenges if there is "real evidence of fraud," but there isn't. The Republican observers have said there isn't evidence of fraud. The international observers have said there isn't. The Trump appointed election security experts have said there isn't. Even a Trump appointed judge along with 2 other Bush appointed judges said there is no case in Georgia. Most of all his own AG has said there is no evidence of wide spread fraud that could overturn the election. So for minions like Giuliani to keep pushing this false, fake, invented, conjured narrative that undermines confidence in the function of the government and do it publicly - THAT'S SEDITION. For someone like Flynn who should still be under the UCMJ as an ex-military officer he should in big trouble. My bet is that's why Giuliani wants the pardon up front. If Flynn's lawyer has a brain they would get him to recant and apologize ASAP because his pardon does NOT include this shit.

I'm watching him almost everyday at the moment for that simple reason I know I am hearing from an expert. He reviewed one of his cases recently and I looked it up and found the actual official final report which I linked in a comment and got a "thank you" from Glenn. I really want to hear him explain the differences between treason and sedition, because right now that's so important for everyone to understand. Flynn is military Glenn was a JAG and the UCMJ has specifics about what military and ex-military can say about the government. Flynn jus re-tweeted a call for martial law. What I would ad to that is the first thing Biden must do is re-engaged Trump's base. if all anyone does is keep that block isolated and disenfranchised then one day they will get back in power with Trump or something worse than Trump. I'm Australian but went to college at U.Illinois UC so I have some very personnel feelings on what's happened to America. If I take the populations of Illinois Wisconsin and Indiana its 25.2 million which is very close to Australia's 25.6 million. Australia has 908 dead from COVID-19 while Illinois Wisconsin and Indiana have over 25,700 (as of todays counts). Australia currently just over 1400 active cases while Illinois Wisconsin and Indiana have over 550,000 active cases (as of todays count). Yes Australia is a lot more spread out and is an island, but nothing can explain away that sort of difference. What's worse is those states are about to head into winter and I know what those winters are like. What's happened so far is not simply tragic its a catastrophe. A big crowded inauguration would be just another very stupid thing to do. America has 6.5 million active cases and a vaccine will not help any one of them. Vaccines only work BEFORE you get a disease. He's actually argued cases before Judge Sullivan who is the judge in the Flynn case. The one case Giuliani's team won was in Pennsylvania where the officials tried to extend the deadline for people to verify their mail in ballots and the Judge said NO you must follow what is already written in the law. You need to stop listening to Giuliani and the other liars. You just claimed (and I quote) "there is a reason for all these losses in court , the judges and supreme courts dont make the call on costitutional law" First you ADMIT that there are REAL LOSSIES in the REAL COURTS. Second making calls on the constitution is exactly what the courts do especially the Supreme Court. That is why the Supreme Court exists. This how much Giuliani and others have twisted reality. Its also defined differently in different countries. It doesn't surprise me that the US Constitution has a specific and narrow definition. Many things in the US Con. were there in response to how the British behaved. Pretty much the entire Bill of Rights was there because of how the British behaved. the thing I'd like to hear a real lawyer clarify is the sedition laws. I know they differ for US military personnel (both serving and retired) which is why I think Flynn might be in a lot of trouble. On Lincoln the simple question to ask is 'What were the circumstances when he imposed martial law." Don't forget Reagan & others called out the National Guard onto University campuses to handle protests. It might not have been martial law in name but it was in practice. But this stuff they are ranting out now is genuine madness.

He worked the system and caught the Democrats asleep. He almost caught them out a 2nd time - HIS VOTE WENT UP. He found a way past the nepotism laws and Jared & Ivanka have made millions from it. By some reports they were making more per hour than Hunter Biden made each month. I saw one report that in just recent year they made $135 million. Based on 258 working days a year that's over $520K a DAY which is 10x better than Hunters $50k a MONTH. I heard the other day he'd raised over $150million SINCE the election and have heard since that its now over $200million. The Trumps are the Olympic Gold medalists for grifting. They are as slippery as eels and we should expect they have an exit plan.

Some countries just got lucky - like Australia. If we had waited as little as 2 weeks we might have had numbers like Illinois. A couple of big sporting events happened just before it arrived and we cancelled major events as it arrived. Also Trump never had 300k in crowd either except in his own imagination. And there were experts screaming about those rallies. Please don't get off topic with the other stuff either. Is been known for years that 40,000 children die every day from a lack of food and about 50,000 die every day from simple infections. Secret evil billionaires are for James Bond films. With the attitude you have there will easily be over 400,000 dead before Biden gets to take the oath and probably 500,000 dead by the end of winter. Its actually very difficult for and constituted leader to commit treason in almost any country because treason is about overthrowing the government. Its pretty hard to do when you are the head of the government but it is possible as Charles I of England proved. He made a deal with foreigners to help overthrow the elected government. Its very hard to convict in America because of the 1st Amendment, which actually exists because of how the British used sedition laws before the revolution. However Flynn in particular has a huge problem because he is ex-military and is oath to uphold and protect the US Constitution didn't simply end when he retired. You can't logically overthrow something that does not yet exist, but you can undermine the institutions of government that has allowed it to become the incoming government. Yeah dude, Flynn's pardon is being challenged and he is NOT YET CLEARED. Plus this new stuff of calling for martial law isn't covered by that pardon.

@valveman12 I see your point but you just said he's acting as in doing activities. Its one of the reasons I want to hear form someone like Glenn Kirshner on the Treason versus Sedition issue. Glenn started as a JAG before working as a federal prosecutor. He has actually argued cases in from of Judge Sullivan who is hearing the Flynn case. He has posted a number of explanations on the Flynn case and pardons. Plus Flynn is ex-military and the UCMJ has specifics about sedition and who better than a JAG qualified lawyer to explain that stuff. I have written to Glenn asking for a vid to explain this stuff and hopefully he will. @valveman12 I'm not here to argue either, but I will correct thigs that I know are wrong. And right now its simply wrong to say Trump is guilty of Treason, for the simple fact he is still legally POTUS. POTUS can't easily be guilty of treason unless he is trying to overthrow the government and he's doing nothing against the House or Senate. Plus Biden is not officially president elect until the Electoral College votes and says he is. But the rest of them and charges of sedition - that's very real as people are starting to point out. Its not an easy thing like it is in some countries and was before the American Revolution. In fact the main reason the 1st Amendment exists is because of how the British applied it. There's a perfect example of that in the film "Last of the Mohicans." Hawkeye encouraged people to defy the colonel. The colonel said I am the king's representative that's sedition and Hawkeye will hang. It was that arbitrary use that made the 1st so important and also why it was the 1st thing they wrote. There is a sort of argument that Giuliani and others might had 1st Am. protection, but it does have limits. On the other hand if you served you'd know that does not exist for Flynn even if he's ex-military he has to watch what he says. You should know the UCMJ better than me and its rules on seditious behavior. You should know that the oath to uphold and protect the constitution does not simply end when you leave the military, FYI - I'm actually Australian but went to college in America and a pack of my frat brothers were pre-law and used to love bouncing my head of the walls with hypothetical arguments because I had different perspectives. So other than America being incredibly important to Australia its also a major part of my life. I love the place I love the people, I love the culture but I hate what a small number of people are doing to a great country. Not certain where you are, I regard my self as part Illinois boy, but take care & stay safe. Other than Trump, COVID's out of control and there's still other stuff we need to deal with. The next few years will be very tough and if we don't work together we really are in deep shit.

He's actually argued cases in from of Judge Sullivan who is handling the Flynn case. He has a lot of interesting stuff to say from a very well credentialed background. I really hope he gets to clarify the differences between treason and sedition and what differences there are for people like Flynn.

It might not be treason because that would mean he's trying to overthrow the existing government and Trump's still the legal POTUS. I have previously asked Glenn Kirshner who has been both a JAG and Federal Prosecutor about clarifying treason & sedition. @JimBananas You're absolutely right but Flynn wasn't trying to arrange the overthrow of the government. I am not a lawyer but my understanding is that the basic difference is treason is "trying to overthrow" versus sedition "trying to undermine and incite." One of those would be very difficult despite the sentiment but the other should be a laydown. He has called for martial law as part of a concerted program to undermine a function of the government. Because he's military the UCMJ might still apply in which case he really is in trouble. Its why I want to hear from someone like Glenn Kirshner who started as a JAG and then was a federal prosecutor. If anyone can explain this properly he is the sort of person who can.

Chuck Nelson A few people might like to see that, but he can think for himself and there are some Dem power brokers who don't like people who can think for themselves. If you have seen heard his comments on Sullivan then the real push should be to expand SCOTUS and get Sullivan in there ASAP. The really smart move by Biden should be to give Puerto Rico statehood and get 2 senators elected. The Reps would go ballistic but farqem.

@JimBananas Pardons should not be scrapped anywhere in any country they are a mechanism of a justice, but like any mechanism of justice they should never be allowed to be abused. If there is one thing that the Biden Admin has to address is the political abuses that have plagued America for too long. That's not an American thing either its something EVERY country has to deal with every so often. Because either you have that cleanout or you end up having a revolution.
