I agree, and I think David's title of the vid id disingenuous. They both made valid points. David's point. Is Ketanji Brown Jackson being asked questions that show how she might adjudicate cases before SCOTUS or are they trying to trap her in a way they can reject her nomination. Michael Knowles point. There are laws that specifically mention "woman" and/or "women." That requires the words "woman" and "women" to be legally defined or how do you know who to apply those laws to or how to apply them? It was good to see that even though it got spirited it didn't descend into a screaming match.

@jmjw00 Fair enough, good clarification.

@computernerdtechman Yeah somebody else has pointed out that. This whole thing is garbage behaviour by garbage people and the best way to stomp on their behaviour is by being very clear on them. If there is one thing bad faith actors can't handle in any argument its SIMPLE DIRECT FACTS.

Where are you getting the quote about a test from? because the 1st Amendment says: "Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances." There's nothing about a "test" of any sort, but your premise is absolutely right. Lindsey Graham has no right to question her religious beliefs, but he would have the right to aske her view on other belief systems because that could show how she viewed one of the main freedoms granted by the 1st Amendment. And that's David's point. Is Ketanji Brown Jackson being asked questions that show how she might adjudicate cases before SCOTUS or are they trying to trap her in a way they can reject her nomination. On the flip side of that Michael Knowles has a point there are laws that specifically mention "woman" and/or "women." That requires the words "woman" and "women" to be legally defined or how do you know who to apply those laws to or how to apply them?

@benthompson8913 Go back and check the comments you're about the 3rd to 4th to point that out. Which is important. There's been way too many people making claims about what is and isn't fact. I'm Australian but went to college in America and it astounds me how bad so many people are on basic things. Which is why I find it great that people like you DO KNOW. I was there in the late 80s and back then Americans actually HAD PRIDE that they KNEW their constitution. These days however, I don't know if Americans realise how well so many other people around the world have some understanding of the US Constitution. I had a bunch of frat brothers who were pre-law and they used to drag me into all sorts of hypothetical arguments, but there are many others way better educated than I am. Because of the fall of the Soviet Empire, many countries wrote entirely new constitutions and most of those copied or did variations of the US Constitution. So there are a lot of legal experts all over the world, with excellent understanding of the US Constitution. I hope that explains why so many people from other places are confused about America these days. We all saw Jan 6th and we all went WTF. We are still trying to get our heads around that. If there is one thing I would recommend Biden do RIGHT NOW. Put CIVICS classes back into high schools. FUND state and national essay and debating competitions where the prizes are college scholarships and bonuses to teachers. Schools that produce results also get extra funding. Label it as a Patriotic duty to protect the Constitution so the GOP can't claim anything. As you probably know there is very scary bunch of self appointed fanatics called the Federalist Society. They scare me more than any other political organisation on the planet. Their control of SCOTUS has very serious effects on global politics and trade that most Americans are NOT aware off. The only way to combat their control is education. FYI - I really do want to see America back at its best. In simple terms we need America going like the LA Rams not the Jacksonville Jaguars.
