You can't dishonorably discharged a vet as they are already discharged. What they can do is recall them to active duty and then charged under the UCMJ. That was mentioned BEFORE January 6 in respect to Mike Flynn. It was mentioned several times the military oath to protect the constitution doesn't expire when someone is discharged. The age 85 was mentioned a few times, but I'm not a lawyer so that one may needs a better explanation than I can give.

As a vet can you explain (or at least confirm) what was mentioned in respect to Mike Flynn. It was said (and I am paraphrasing) the the military oath to protect the constitution does NOT expire when you're discharged and remains in place until you're 85. Anyone can be recalled to active duty and charged under the UCMJ, which does not provide much 1st Amendment protection. I'm not a lawyer and have never been a member of the US military. If you can clarify this even a little it would help everyone.

@wendellhammack7691 Good answer and a great link. I usually put up the Wikipedia page. The levying of war is a very hard one to argue however because because you have to have some declaration. Your getting into the very definition of what war is and isn't and where the boundaries between riot, insurrection and war lie. There's also the boundaries between protest, sedition and treason that anyone knows lawyers have 1000s of opinions on. A huge part of the problem is that in response to how the British colonial powers used sedition and treason charges for almost anything they didn't like anyone doing, they gave the American people every narrow definitions of Treason and Sedition (way narrower than any other country). It was so the Federal and State governments could not use them as weapons against the civilian population as the British had. People like Legal Eagle and Glenn Kirschner have spoken about these issues here on YT.

No its their oath to the constitution and they have a problem. Their oath does not simply go away after their service. They can be recalled to active duty and charged under the UCMJ. David also forgets to mention the worst domestic terrorist event in American history with the Oklahoma bombing done by a vet, Timothy McVeigh. The real question that needs answering is WHY and if no one bothers to do that then the problem is NOT going away?

@itsmeGeorgina I saw an ex-military guy interviewed a while back (I think he had been a general) and he said Flynn could be recalled and charged. He also said that Flynn had spent much of his career in military intelligence where the rules don't apply like they do in other areas. So he's operated with out restraint for much of his career. 🤷♂️🤷♀️

@itsmeGeorgina I don't really worry about the bulk of the trump supporters. They are more angry and frustrated with the political establishment than anything else. @wendellhammack7691 Well if you listen to both Legal Eagle and Glenn Kirschner you'd know there's NO LEGAL BASIS for Treason. Legal Eagle did an extended vi don that only days ago -> https://www.youtube.com/watch?v=YLeMKM4ArlA So why are you trying to argue something you know is legally baseless? Treason is a non-event due to the very narrow definition in US law. Where as Sedition is, even though its also incredibly hard. The only way they could possibly get treason would be if they magically dug up something where Trump was knowingly working with a foreign country to damage America. And despite all that people have claimed nothing of that sort exists in the public discussion that would actually hold up in court. Somebody just pointed out yesterday that with the law suits from Dominion & Smartmatic they are hoping that it does NOT settle out of court so that the DISCOVERY process happens. Because then we will know who called who and who said what and who was directing it all. That has serious potential for Sedition and or Conspiracy charges to hold up. There's the line out of a Few Good Men about it not mattering what the truth is, it only matters what you can prove in court. Its something the Trump supporters haven't understood in the slightest and the rest of the planet needs to be more sensible that Trump supporters.

@TalentCaldwell I think your right or it least it sounds right. I know at least one person saying that was on MSNBC. I'm no fan of MSNBC or Chris Hayes, I think he's part of the disease that is "opinion being broadcast as news." But I remember that its been repeated by several ex-military people that the oath to protect the constitution doesn't simply go away with retiring. If someone would clarify why the age of 85 was mentioned that would be good.

@phiksit Do you know if its all ages or is there a limit to being recalled? When it came to discussion son Mike Flynn a couple of commentators mentioned he wasn't yet 85.

@merricat3025 Actually its a long standing stat that a very high percentage of the military vote Republican. As far as I know most military people around the world vote towards the right side of politics.

Its one of the great quandaries of human society.

oh ok Its been like that for 1000s of years. Armies are useful tools to get rid of problems in either your own society or your opponents. I know its ugly to say it, but its a form of population control.

@mnomadvfx And no matter how much they try they never get all of them or think they can "mold" others. The police deal with the same all over the western world. The fire brigades have to look for people with "hero complex" issues. No matter they don't catch them all and then they don't catch all those who change for the worse or truly horrific, like Timothy McVeigh.
