Steve Slade That's because the nations established in the Americas were colonial, and therefore legally set up for mass immigration. Our economic structure and our welfare state no longer allows us to sustain that type of immigration, and that is obvious.

From my understanding, the misinterpretation is in the part of the clause that says "All persons born or naturalized in the United States and subject to the jurisdiction thereof " Foreign nationals are not subject to the jurisdiction of the U.S. The 14th implies jus sangunius naturalization i.e. your parents are citizens i.e. you're subject to the jurisdiction of the United States.

@Mrko3ak2020 It can be overturned by a SCOTUS decision. The 14th is open to legal interpretation.

@Mrko3ak2020 It is less ambiguous, but I think the part that's up for interpretation is firstly, the spirit/context of the law i.e. the law was designed to grant slaves citizenship, not establish unrestricted jus soli naturalization. Also in the wording of the citizenship clause that states "and subject to the jurisdiction thereof." To some, this implies that the person cannot be subject to the jurisdiction of a foreign country. If the parents are citizens of Mexico, their offspring is also a citizen of Mexico i.e. subject to the jurisdiction of a foreign country.
