It was not Dixieland Square Mall, it was just Dixie Square Mall and it had already been shuttered before the movie purchased the rights to film/trash it for the movie. After that, it sat in disrepair and allowed to decay while multiple redevelopment attempts were made. It was finally fully demolished in 2012. So I'm not sure where you got your info, but there was no lawsuit, and the mall was well and truly closed by that point.
