  1. Personally, I think software patents shouldn't even exist. So this shouldn't even be an issue if our laws were entirely sane. The example of a library is probably a bad one though, since dynamic linking means you don't need to use the code directly but rather through an API. In effect, it would be like the LGPL with that usage. Of course it would prevent you from static linking in that way and that might actually be a good thing because we should embrace more dynamic linking. I don't like downloading 100mb apps that are really 5mb of new code and 95mb of statically linked libraries. You know what I mean?
