I'm no lawyer, but I feel like that's super illegal. If it's not illegal, it probably should be. Then again, a lot of things that various tech companies do should probably be illegal but with their lobbying power never will be.

They say it doesn't store the source, but that's BS, it's in the model in a non-linear form. That means it's got all of the source code and probably multiple times over, or at least internal links to snippets multiple times over since they'd likely use a data structure that eliminates excess duplicates. I'd say this behavior is indicative of how MS feels about open source and how they've always felt: if it's open source then they can do whatever they want with it and if you try to steal their end result you're in the wrong and not them. Basically, they take ownership of all they see and tell you, either as an end user or as the developer of said source, to get fucked. It is without a doubt illegal as it breaks copyright in several ways, but as has been demonstrated by their past behavior, they don't care and won't be punished. My advice: don't use GitHub, and instead only use services that respect your copyright and thus ownership of your code.
