@joannleichliter4308 I'm not sure about impeachment after leaving office though there's nothing in the Constitution that prevents it that I'm aware of. The Constitution is pretty clear about the chain of events that must occur for a President to be criminally charged for crimes committed in office. Civil litigation they're not immune from obviously. The Supreme Court found that way because the Constitution explicitly says high crimes which is criminal court, not civil court.

They aren't immune from prosecution if they commit a crime outside of office. The Constitution allows for prosecution of high crimes. It requires a conviction of impeachment first. If a President committed some of those crimes, they'd be removed by impeachment thus they're open for prosecution. That's how it's done according to the Constitution. Unless you want the Constitution rewritten, that's currently what it says. Edit: Smith is trying to avoid the delay the appeal creates. It'll end up at SCOTUS at some point anyway. He's trying to get Trump in court in March, I think that's the trial date, of next year. They're hoping a conviction will stop people voting for him, or have his support of the RNC removed.

The insanity that ruling a former President can be charged will create is frightening. If the Supreme Court takes it up at this time, which they'd be smart not to, they can only decide one way. Most of them (excluding the affirmative action judges) will consider the longterm implications of their decision and that it would turn us into a Banana Republic overnight.

They'd have to be convicted of a crime before that could be determined though. Being charged doesn't automatically mean they're guilty. That's why, according to the Constitution, they have to be impeached for that crime first. Then they will have been found guilty prior to criminal prosecution. Edit: That's why they attempted to impeach him as he was leaving office. So he could face criminal charges afterwards. The Constitution allows for high crimes. Which he's not been charged with anything that would be considered one. Using the legal resources set up within the Constitution to question the validity of an election isn't a crime as much as they want it to be. Filling a case knowing you'll probably lose isn't one either.
