I don't know that Kavanaugh is an institutionalist. He's had decisions going both ways. Barret absolutely is. I think after his confirmation hearing Kavanaugh is very aware there's a political target on his back. Unlike Thomas who pretty much went f u after his ordeal, Kavanaugh seems to be stepping very carefully. I've listened to his questionings and he can go hard.

You can petition your Congressmen to do that. That's who removes them. They can be impeached. It's also difficult to say they "don't follow the Constitution" since they interpret it.

 @InfinityEightplus The most recent appointment was Barret. I doubt Dems would have forced someone to retire during a Republican president. I don't think they're that stupid.

Kavanaugh has been okay. I understand his situation when it comes to anything involving Trump. Especially when almost everything was under Democrat control. They'd have loved nothing more than an excuse to remove him and appoint a justice. Something unthinkable in the past is just political strategy right now.

@ohsweetmystery Unfortunately most of them have never even been over a case. As bad as the diversity hire is, at least she had a record to look at. Thomas was one of the few that practiced extensively before being appointed. They also can't say how they'd decide on hypothetical cases. Doing so would be an automatic no. Every case is completely dependent on the facts and arguments presented by both sides. Edit: Every section of the Constitution has massive amounts of case law that pertains to it. It's impossible to know all of it off the top of your head. Not to mention each clause and word can have multiple interpretations over the 200+ years.

Not the Supreme Court. Imagine replacing every justice during the last 20 years. 16 of which were controlled by Dems. The Supreme Court is a lifetime appointment to keep them from being easily influenced based on who's in charge. Whoever appointed them will be out of power soon in their service. It's also to prevent whims from having as big an impact as they could. They have a check by Congress and can be removed.

I think Thomas has said he's is going to. Hate to see that man go. This is why it's never made sense to yell Republicans are racist because he's everyone's favorite justice. I honestly don't know if there are very many Constitutionalist lawyers out there. Especially on the list. Appointments are based on a list made up by conservative lawyers in a think tank. Who's the one suing everyone over DEI? He's got a nonprofit running doing it.

He won't. He's been salivating for a Commerce Clause case. He wants to gut it. The only thing he's massively based about. He thinks it's been expanded way too far. Just like Thomas had been waiting for a gun and abortion case.

I've never heard conservative lawyers call him that. He's a fence sitting liberal. His main issue is the Commerce Clause which he's based on. Everything else, he's a toss up. I'd much rather have 4 more Thomas's. He's a staunch Constitutionalist which is what every Supreme Court justice should be since that's what every decision is based on.
