  1. “Everyone knows he’s not going to win it”. Yes he will because there’s a process laid out in the Constitution on how to charge and convict a President for his actions in office. It starts with a successful impeachment of those charges. So they won’t set a blanket immunity but instead highlight the process and say he is immune because that process did not occur in order to bring these types of charges. Obviously it’s going to be a change from the lower courts and clarification or they wouldn’t have taken a case not even to them yet.
