  1. The judge wants a jury verdict. He believes that juries are smart enough to see through all the BS. If it's not not guilty, I do believe he will call a mistrial. If he doesn't, the decision won't withstand an appeal and Kyle can remain free during the appeal process by court order. Kyle needs a not guilty to be able to go after the media for defaming him. He could also then sue the state for malicious prosecution as well. The gun charge alone gives him that.
