Most lawyers were aware of the vulnerability of Roe. It was a clear case of legislation from the bench and most knew it eventually would be overturned once the right argument presented itself. It was never going to stand the test of time. Lucky it only took less than 50 years. The other cases he was saying need to be brought back before the court to strengthen them. Not that the decisions were viewed the same as Roe, but because they were originally argued partially under the right to privacy when it's not needed for them. They laid the groundwork to preserve those cases by talking about the history and stuff. They all fall under the Civil Rights Act and other such laws so that's what the decision should reflect. Edit: Thomas's warning was basically that just like activist judges created Roe, in the future they could remove those cases by using the overturning of Roe as a basis so they need to guard them against with a better written decision on them.

@markdsm-5157 So wait, you think a couple of politicans saying something they know they can't ever do because there's mountains of case law about crossing state lines dating back to the founding is equivalent to encouraging, helping, and paying bail for people committing violent acts against your political opponents? That was even brought up during Covid and the states threatening to ban, fine, or arrest people entering the state was slapped down. That's like people saying a woman will be charged for murder is she does it out of state. Can't be done because the "crime" occurred in a different jurisdiction. They can't do that anymore than they can prosecute someone for possession for going to a state marijuana is legal in. Edit: Arkansas was one such state. Not because we were worried about the spread. That was New York. We never closed our parks or much outdoor activities so people from other states were flooding in taking over our state parks and other stuff, trashing it, that our tax dollars maintained and we couldn't use them. The people were PISSED begging for our governor to get them out. So instead he banned them from being able to spend the night so the RVs and mess left.
