The thing missing in the explanation is intent. Was the intent to make the weapon function as one? You can sell someone flour and tell them it's cocaine and go to prison for selling drugs because that was the intent.

@sprky777 That's not what Jury instruction is. It's explaining the law as it's written so the jury is informed on the wording of the law. If the judge does go beyond that, it's solid grounds for an appeal and most judges want to avoid that.

@bunberrier False. I don't like the ATF but you don't need to lie about them to make them look bad. There's plenty of truthful stuff they've done without needing to resort to lies and they only weaken any point you have. You can build a Gatling gun and it's perfectly legal. Muskets aren't considered firearms either.
