  1. 8:16 It is indeed a criminal offense. It's both civil and criminal. Improper entry can result in fines and/or imprisonment. They've started calling it not a crime because most don't face imprisonment and are just deported. I've also seen the claim that since it's a misdemeanor it's not a crime. Except that most people prosecuted for crimes commit misdemeanors. It's the equivalent of saying speeding isn't a crime or that misdemeanor assault isn't.
