It's not even that. Illegals are supposed to be held in detention until deportation preceedings. They're conflating that with being held for shoplifting. Once the charges for whatever crime they committed are dealt with by the state, they'd go right back into federal custody. Guilty or innocent of the crime charged by the state. If guilty, they'd return to federal custody once that sentence is completed.

Them being so upset they'll be held until trial is also them shifting language. An illegal is supposed to be detained until deportation proceedings. That's in the law. But they're trying to claim they'd be detained indefinitely on the shoplifting charge. The real reason those particular Congressmen had a problem with it is they represent sanctuary areas. This law would then make them being one illegal. They'd be legally required to cooperate with ICE.

@TheMINDL3SSGamers You're confusing human rights (life, liberty, and the pursuit of happiness) with the Bill of Rights. Life, liberty, and the pursuit of happiness are the rights endowed by your creator. Deporting them isn't imprisoning them which would be removal of liberty. Deporting them doesn't violate a single right. Due process is if we're going to prosecuted them. This bill has nothing to do with that. It's hold for ICE to deport. Which is a different legal process that they can exhaust, but has nothing to do with the shop lifting. Being in this country isn't a "human right."

Except they wouldn't be being held for theft. They'd be being held awaiting deportation orders like they should be the first time they're encountered.

I'm seeing this a lot. That's exactly how Democrats want to think of it, but that's not true. They'd be detained federally in compliance with immigration laws on illegal immigrants. They're supposed to held until deported so that's what they're in detention for. The state charges have nothing to do with them being held in custody. Just that they be turned over for deportation proceedings to begin.

That's what this bill would do. They'd be detained federally waiting for them to legally be given deportation. These politicians are are twisting it to them being held for shoplifting.

That's the immigration law here as well. Once encountered, illegals are supposed to be held until deportation. They're making out that they'd be held for the shoplifting, but they're not. Ones federal and one's state.

They're telling you right in this video. They're conflating being held federally awaiting deportation orders with being held for shoplifting by the state government. That's because they don't believe they should be held for anything at all. They want amnesty and open borders. That's why they'll say "no human is illegal" and other stuff.

Technically the Supreme Court has held they're afforded certain rights. Especially in the judicial system. Those are illegal search and seizure and legal representation. That's where Miranda rights come from. They can be detained though because that's written into our immigration policy which is why Democrats want "reform" and call it broken.

I'm seeing a lot of postings about red flag laws. The problem is, they wouldn't be held without due process. The detention is federally for entering illegally and the law says they're held until deported. The bill would simply have them in federal custody awaiting deportation while the state charges work through the system.

@coffeebux Nope. That's why citizenship is defined in the Constitution. As long as you maintain your paperwork that proves your citizenship, they can't. The only rights illegals have is no illegal search and seizure and legal representation. Since by the nature of being here illegally immigration law is detention until deportation, they can be held federally. This particular law makes sure they are and strips sanctuary status from cities and states. Edit: The rights endowed by your creator are life, liberty, and the pursuit of happiness. That's why the only "rights" illegals have is in regards to the legal system. Them protesting is hilarious because under the Constitution it's the right to protest your government. This isn't their government.

7:10 You mean like would happened to a citizen? A citizen would also be arrested. At least 10-15 years ago they'd pretend to think illegal immigration is bad. What's really funny is going by the polling and stuff from the last election, over 80% of the popular wants them deported. Yet, they keep acting like they're speaking for the people. 8:13 I can attest to that. As a teenager I was a proflic one. Never got caught.

They'd detain them. Not arrest them. An arrest would occur once they had enough evidence to charge. They'd be taken in or even held in a room in the store for questioning, but not arrested. Which, if you inform your children of their rights, they're allowed to walk out of at anytime. If you ask if you're under arrest and they say something like we're just talking, you can get up and leave. At that point, if they have enough, they'll arrest. Edit: Also technically, they've not shoplifted until they attempt to leave the store without paying. Just putting something in your pocket isn't illegal. I taught both my boys if they caught the attention of police and they attempted to take them in without officially arresting them to say no or walk out. If they arrest the only thing you say is lawyer. My dad was a cop.
