@k-ozdragon There’s always been prosecutorial discretion. What it’s supposed to be for is when it’s clear the individual isn’t responsible, child or mental abilities of one, for their actions. Or when there’s just not enough evidence at the time to prove the case. Now it’s been warped into not prosecuting certain crimes at all. So why the special council is saying he’s not recommending charges falls under the normal use of that discretion. In Hillary’s case Comey said couldn’t prove intent which is a key part of the charge. In this case he also cited you can’t prosecute a sitting President meaning without the other he’d be facing charges following his removal. Edit: He went out of his way to attempt to differentiate what Trump did vs what Biden did, but Biden’s was actually much worse. He did share those documents with someone. Trump didn’t even have the documents he’s referring to in the recording according to the FBI. He was careful though to add alleged when he referenced Trump though.
