  1. You'll see this a lot with leftists. Just like the minimum wage thing. They want you to focus on the federal minimum wage rather than the state because the state minimum wage can be changed much more easily. You get a petition, collect signatures, get it on the ballot, and people vote. They don't want to fix what they see as a problem, they just want to complain about it and you pay them to do it.

  3. How is it being abused? Very few lawyers in a traffic accident sue the individual. That's only done if the person doesn't have insurance. You sue the insurance company and go for the deep pockets. If you sue the individual who makes next to nothing, you get paid next to nothing. It's the first thing you're taught in tort law.
