  1. The defense didn't claim the gay defense. The prosecution brought it up. This person had a long history of doing this too. The first encounter was in a dark alley. Afterwards he told the college student to invite some friends next time. The second encounter the person wanted anal sex. The only reason the player found out was because he shined his flashlight from his phone to the front of the man after the act had begun and revealed a penis. You left a lot out of this and I'm honestly disappointed. I don't care what your opinion on it is, but leaving out key details is pretty dishonest and was obviously done to strengthen your viewpoint. Even the prosecution said 2nd degree was too high because they had to prove intent and they probably should have gone with manslaughter. Had they not charged so high, he likely would have been convicted. Even they thought they didn't prove he had real intent.
