  1. Congress CAN NOT prosecute crimes or put people in prison. EVER. Congress is not law enforcement. Congress cannot even investigate crimes. Congress is limited to investigations for "legitimate legislative purposes". IF they "happen to" uncover evidence of potential crimes during the process of a legitimate legislative investigation, they MUST turn over that evidence to the DOJ for criminal investigation. The DOJ then decides whether to pursue a criminal investigation and/or prosecution.
