The DOJ doesn't "decide" anything other than whether to bring evidence to a Grand Jury for a possible indictment and then bring evidence to a jury in court for a trial. The only question the DOJ needs to answer is "Do we believe we have enough evidence to unanimously convince a jury of 12 people, beyond a reasonable doubt, that Hunter Biden committed a crime"
