  1. Swalwell strikes out. That said, Garland is no longer a judge. There is a reason for "separation of powers". A COURT will decide if Bannon needs to comply with the subpoena. There is ample precedent that Congress can only subpoena people/documents for the purposes of legislative consideration. If there is no legitimate legislative purpose, the Congress has no subpoena power. Congress is NOT a police or law enforcement agency or a Grand Jury. Congress is not empowered to investigate crime.
