  1. They need to take this move because the Democrats did NOTHING to codify "abortion rights" for 50 years. Whether the Fmr. Lt. Governor is right about Congress not being able to make a federal law on abortion or not, would be another matter for SCOTUS to decide. I see her argument that it does not. Then again, there are LOTS of federal laws that address issues not enumerated to congress in the Constitution, except by some abstract, such as the "interstate commerce clause". In any case, the Democrats have controlled Congress, and the White House for MANY of the past 50 years, including filibuster proof 60 seat majorities in the Senate TWICE, most recently 2011-2013 and DID NOTHING to codify abortion "rights" with federal legislation OR a Constitutional Amendment. I am not aware of ANY Senator's position on abortion not being known. This is damage control by Democrats.
