  1.  @erin9868  I think you’d be hard pressed to prove that “looking like a package worth stealing” is some kind of justification that he’s baiting thieves any more than a package its owners prefer not be stolen is baiting thieves. It’s designed to look like a box. I’ve had expensive packages delivered to my front door that clearly indicate “THIS IS A SAMSUNG TV”. If I open the door and kick a thief in the face who’s trying to steal it, was I baiting him?

  2. That is not a basis for carte blanche defense of private property, as LE laid out in this video regarding Katko v Briney. The defense of Mark’s actions lies in the fact they are not assault and battery, not that you can arbitrarily defend private property against trespass.
