Its up to them and ICC what happens thereafter. Icc can still charge a US politician. The politician likely wouldnt cooperate. That doesnt mean he couldnt still be arrested if by someone if they had the guts and wanted to give it a try. Then it would be up to the parties involved to deal with it however they see fit, just as it is now for Russia, with Putin branded a fugitive. WHile US feels they arent subject to ICC law, Biden did say he agreed with the charges against putin and that it made a real statement.
