@rahn45 The only clearcut issue here is the default judgment. I'm not even sure that wasn't a litigation tactic rather than something imposed on him, and imposed unjustly. I hope it will be well argued on appeal. It's important for everyone's due process rights.

@Brian H Is there evidence sufficient to assert that the massacre was staged? Errors are contemplated by the NYTimes malice standard, which only excludes deliberate, knowing lies, or reckless disregard for the evidence, as opposed to mistakes made in the heat of the moment and promptly corrected. Besides, who was defamed by that mistake? I don't know that Lanza's mother was a productive person anymore. I think she was retired or semi-retired. You don't have to believe anything.

Did you notice the same thing during Depp v. Heard? If you hated Heard enough to miss it, did you at least pick up on the ridiculous $2 million verdict against Depp, for something he didn't say? These were ALL First Amendment cases. Hey, kiss it good-bye, they got everyone to diss it, "both sides."

@Brian H How could there not be? One set of questions and claims has an evidentiary basis. The other does not. In defamation, and under the New York Times malice standard applying to broadcasts about people and events of legitimate public concern, that's the whole shebang.

@Brian H With respect to any statement, which is true or false, the possible epistemological positions are multiple: knowledge that it is true, if it is; belief that it is true, whether it is or not; knowledge that it is false, if it is; belief that it is false, whether it is or not; acknowledgement that one does not know whether it is true or false. At least these. Goldbach's conjecture is certainly true or false. No one knows which.

@Brian H Actually, not every theologian agrees that faith is a choice. Many believe it is a divine gift.

@Brian H Okay, now we know. You don't know logic. Obviously you don't consider that a problem. You also imagine that memorizing a many-times-translated Bible study group verse gives you deeper insight that that of people who devoted their entire lives to reading ancient languages, understanding religion and religious faith, the mystery of revelation, and so forth. When I taught philosophy, I occasionally met people like that. It was before the heavy social media and belligerent ignorance became entrenched. I bet you'd all get lots more Likes today.

@Brian H A photograph without chain of custody and testimony to authenticate it is never evidence in court or any serious proceeding. Literally never. The burden of proof is in the proponent to prove the photograph is real, or at least to show some evidence that it is, and that it actually shows what that person purports it shows. If anyone could easily believe such a photo, of a kid who was killed at Sandy Hook, is real, then this society is lost.

Martha Stewart was never convicted of insider trading, or even charged with that. They went for the easy win: she lied to federal agents during an insider trading investigation, trying to make herself look good, and to hide her affair with the object of the investigation. Well, that was so stupid. Remain silent. It's still a right.
