That tells you everything. No dishonest, disingenuous, insincere person ever puts it in writing, knowing it could be used against him.

@edward481 He said it out loud in the newsroom, their shared workplace, and everyone laughed at Ana. Context matters. Notice I didn't say it was sexual harassment -- much less "hostile environment." Anyone with a passing knowledge of the law would know that Jimmy's joke doesn't rise to that level. It does not come close to that. He did the right thing by saying he was sorry, in a card, and showed real class by buying a small gift as well. If Ana needs money, she could auction the card?

@edward481 Er, what makes you think you have freedom of speech at work? No. Everyone knows you don't. I hope everyone knows. It's a private business. Government can't force them to grant employees free speech rights. It would violate their freedom of association. (I.e., the freedom to fire you if they don't approve of what you say on their premises during work.)

You think Microsoft can't fire someone who updates other employees on the latest Bill Gates-Jeffrey Epstein revelations? If they don't fire him, it might be because they fear the publicity. But it's up to them to weigh it. The government can't do anything about it. The employee can't win a suit based on the First Amendment.

@edward481 I don't agree with it. I'm telling you the truth. In America, you can express any opinion you like, or make jokes, and your job can have security escort you out the door the same day. That's how it works here. That is literally the law, absent a contract (such as a union contract) to the contrary. Where did I say I agreed? You'd advise individuals to test it? They'll risk being summarily fired without a right to unemployment compensation.
