"Hate speech" that doesn't fall into an unprotected category (defamation, intentional infliction of emotional, distress, which are civil causes of action, or true threats, incitement to imminent violence, speech in furtherance of a criminal conspiracy, etc., which are crimes) IS constitutionally protected speech. Look up R.A.V. v. City of St. Paul. That's the law, and has been for decades.
