  10. You mischaracterized hearsay. Hearsay is, "he told me this happened." Well, HE has to come in and be the witness to what happened, not some third person he supposedly told. "I was present and I heard X" stated under oath and for the purpose of proving not that X is true but that X was said is NOT HEARSAY. "I heard the defendant scream, 'I will kill you'" -- not hearsay.
