If we therefore consider it to be speech (probably the better view), we then consider whether it falls under one of the very few, narrow exceptions to constitutionally protected speech --- namely, incitement to imminent disorder. Take a look at US v. Alvarez: no general ban on lying. It may come as a surprise to a lot of people.
