Did you read the briefs? Then you don't know. Every brief in every federal court must correctly establish the court's jurisdiction over the case. The court will then address its jurisdiction before ruling on any issue in the case.

Take a look at Clinton v. City of New York, where the Court struck down the line-item veto as unconstitutional. Justice Stevens wrote that opinion, and he was appointed to the Court from the Seventh Circuit, too. The Seventh has this reputation, as being more intellectual overall and less likely to be partisan.
