You need a declaration of homicide to pursue a suspect. If he stole her van, they could have gone after him for that immediately. (Was the van in her name alone?) If a person steals another person's car and leaves them in a dangerous area, that is a serious crime.

@kjw7228 Well said. The time for confession is to the District Attorney and then the court under oath. It is terrible. Gabby had a chance to get away. Heartbreaking.

@tamaraelsberry6630 If the Laundries had potential criminal liability, then they were right to remain silent. Didn't you listen to the judge? He is very clear. Gabby's side is stating they cannot invoke the 5th because they had no potential criminal liability.

@peterquennellnyc No one who is not under subpoena has to justify remaining silent. If you exercise a right, you do not have to defend yourself for exercising that right.

@peterquennellnyc SILENCE IS NOT OBSTRUCTION OF JUSTICE. Good God, what does it take? Speak to law enforcement, inadvertently say something misleading just because you are nervous, and THEN you are in trouble. You can remain silent; you cannot lie.

@YoureDoingItPeter No, the lawyer can either do his job properly, or refuse to take the case. The lawyer has done nothing wrong. Legally, Laundrie (or whatever his name is) is presumed innocent.

@MikeBDaniels-bv8io No such official declaration has been made. Was the van registered in her name only? The police could have held him on stealing her van and leaving her in a dangerous area. Police often act as though they know more than they actually know. This can't be news to anyone.

@ShoutItFromTheHousetops How do you not understand? It's all explained here. You cannot force anyone to speak. What is so mysterious about that, in 2022? They had very good reason not to speak: the smallest MISstatement could cause them to be charged with obstruction of justice. Silence never is obstruction (absent subpoena), because the Constitution guarantees you have the right to remain silent. The US rededicated itself to that principle after the Stalin show trials.

@tcurry1531 There is no such law in Florida. Helping to conceal someone from law enforcement is an affirmative act. Failing to report what you "know" (which in this case amounts to what a son told or failed to tell his parents) is not accessory after the fact. Maintaining silence and obtaining a lawyer are unequivocally constitutional rights, hence cannot be crimes. Did no one listen to this entire video? Gabby's family's lawyer is arguing that the Laundries had no basis to invoke the 5th Amendment right to remain silent because they were at no reasonable risk of criminal liability. No one wanted them for any crime.

@tcurry1531 The Laundries themselves did not say anything. I was referring to the PETITO family lawyer, who said loud and clear that the Laundries were NOT under suspicion of criminal wrongdoing and hence for that very reason had no basis for invoking the Fifth Amendment. The rights you are willing to give up may come back to haunt you some day. Opinions are fine, but they do not change the facts nor logic.

@NobleNikki It's not "huge." If they were to have a judgment entered against them, they can sue the attorney and his malpractice insurance will cover it. In any event, everyone should oppose IIED and defamation verdicts based SOLELY on an attorney's speech. That is perverse.
