Compassionate use, provided there is no solid evidence of harm ("first do no harm"), is a very common off-label use of approved drugs, and a common exception to the policy of using only drugs that are "proven safe and effective." For compassionate use, proven safe, with some possibility of effective, is sufficient. I don't understand their initial refusal.

  2. "Compassionate use" is established as a common exception to FDA approved based on safety and effectiveness, ESPECIALLY for off-label use of drugs that already exist and were approved for something else. It's done all the time.
