In the US, as long as it's a theoretical assertion, it is legal under Brandenburg v. Ohio. Rubin is mixing scenarios that are considered entirely distinct in America.

Why? He's a hate spitting twerp. Not very long ago, his lifestyle was a crime in UK. What sort of bigotry is he determined to unleash, that he's SO sure it won't come back to harm him or the people he cares about?

Great post. Also, Rubin is misleading people about American law. "Promoting violence" as a theoretical matter (as Jefferson and Paine did) is legal in the US. "Inciting imminent violence" is not. Brandenburg v. Ohio is the seminal case that explains it. And the ACLU was right. Glenn Greenwald has been posting videos where he reads through Brandenburg step by step. (Obviously, Piers, Murray, or Rubin fans won't look it up themselves.)
