  19. Maybe you should take a look at the Westboro Baptist Church case; RAV v. City of St. Paul; and Brandenburg v. Ohio. RAV was a Scalia opinion, and Scalia joined the opinion on the flag-burning case (Texas v. Johnson, I believe). You're confusing the First Amendment with Miss Manners.

People who criticize every such effort (and this one really deserves it) do need to put some energy into proposing real solutions. As for Briahna, she needs to speak more slowly, with fewer digressions. She sounds like she is speed-reading a legal brief, not presenting an opinion as a newscaster who wants to communicate with the audience.
