Not what Kim said.

@burtonsnow845 That, too, absolutely. But keep your eye on the ball.

The Section 230 premise is that Internet platforms are like bookstores or telephones, not editors or publishers, or writers, or speakers. They cannot be held liable. Yet they DO ACT as editors. Kim just pointed this out.

In California, a lawyer tried to remove proven defamation from Yelp. She had a judgment in hand, and only what was specifically adjudicated as defamatory could be removed. Yelp said no anyway. The California Supreme Court agreed with Yelp. So, even if you are defamed and prove it, tough luck. The Internet does not work this way in Europe.

In California, a lawyer tried to remove proven defamation from Yelp. She had a judgment in hand, and only what was specifically adjudicated as defamatory could be removed. Yelp said no anyway. The California Supreme Court agreed with Yelp because of Section 230. No one was asking for damages, just removal of the defamation. So, even if you are defamed and prove it in court, tough luck. The platforms can do what they want. The Internet does not work this way in Europe.
