Civil liability is never higher than "clear and convincing evidence," which is lower than for any crime, and would apply to negligent or grossly negligent accidents, reckless conduct, failing to report an accident or error out of fear or humiliation short of committing a deliberate crime. This other stuff about smoking guns is journalistic blah blah.
