@joeterzio7175 Except that it is perfectly plain that the choice surrounding whether to take the vaccine was nothing of the kind. If the emergency were what you claim it was, worthy of withdrawing freedom of choice, there would be patents lifted, vaccines from Russia, China, and Cuba freely available, and vaccination would affect spread, not just severity. But COVID's dangers, significant as they are, have been greatly exaggerated. The latest omicron wave saw the most heavily vaccinated populations hit first with surging infections.

@dqh6429 Constitutional rights are something that cannot be taken away from you, by ANYONE in the government, without amending the Constitution. You have the right to decline to exercise them. You have the right to try to persuade others not to exercise them. The right to use birth control, including forms of birth control that may prevent a zygote from being implanted, falls under that very same analysis. A lot of religions oppose artificial birth control. Some even frown on rhythm. They have a right to advocate for their view, but not to criminalize those who disagree.

No it isn't. It's saying what was once a right us now subject to vacillating majorities in state legislatures. Whatever is codified can be repealed just as easily.

The First Amendment doesn't mention artistic expression. Should the several states have Art Codes, too? The Thirteen and Fourteenth Amendments don't mention interracial marriage. Should marriage licences for couples of different races be state-by-state? So Kim's parents could have been married in some states, but not others?

@dqh6429 The constitutional right to elective abortion prior to 12 weeks of pregnancy has just been withdrawn. It was a right I had my whole adult life. Now it's up to the state, not the individual. BTW, I knew vaccine mandates were softening up the public for this.

@dqh6429 Exactly. Each state can do whatever it wants, based on who puts the most money into electing legislatures to enact their preferred policies. A rich enough lobby can pass laws to put people in prison for bringing the morning-after pill into the state.

I recommend you read a 2010 Yale Law Journal article entitled The One and Only Substantive Due Process Clause, which analyzes the Fifth and Fourteenth Amendments from an originalist perspective. See what you think. By the way, I have a library. No television at the moment.

@leonhart2178 Roe didn't make any laws, actually. It preempted laws that curtailed a constitutional right. The very same thing happens when a law is struck down for curtailing First Amendment rights or Second Amendment rights, and so forth.
