@centionnaire It's a human embryo. Should a ten-year-old child be required to carry it to term and risk her life to give birth? I think her case woke people up to what state interference actually is. Here's a thought: It is not up to you to decide. You have no right to criminalize her, her parents, and her doctor.

In Europe, the state pays for abortions at least in large part. When I lived in France, which at that time required counseling and a number of other measures before approval of elective abortion, the state still paid 70% of the cost.

@AnaLucia-wy2ii No. If the Supreme Court holds that something is a constitutional right, then it is. We are not talking about intuiting Platonic forms. This is an empirical fact of how our constitutional system operates. Also, it does not mean the right cannot be cabined. Read some cases and see how that actually works.

@sarahg2653 Yes, Fox News tried that angle. Unfortunately, the chilling effect of Ohio laws, the obvious need for certainty, and the fact that time was of the essence did drive this family to cross state lines. No, there is no lie about that; I'm a lawyer, I know.

The pregnant ten-year-old girl who had to travel to obtain an abortion, her doctor who got death threats, the way Biden apparently used her to make a political point, and the extreme right that claimed she didn't exist opened some eyes.

They didn't just pick this issue. It is making a difference. It appeared that the Democrats were about to get punished for the state of the economy, general incompetence, and their lying about opposing vaccine mandates, until they got elected and then began coercing people. Well, they've quietly backed off from the mandates. Now, the Republican fringe is making a ten-year-old cross state lines to get an abortion, and her doctor got death threats. In the meantime, Fox News said she did not exist, and never apologized. That caught people's attention.

@sarahg2653 You think there was time and money to go to court to get a declaratory judgment? Traveling was cheaper. When you feel like invoking the heavy hand of the state, just be careful what you wish for. It could backfire on you.

@sarahg2653 BTW, I say the same about Biden's disgraceful speech the other night. This society is becoming dystopian faster than I can keep up, and I'm pretty tough. Nor am I a libertarian; I think they're childish. But it is no accident that we literally have the most incarcerated people in the world, in actual numbers and as a percent of the population. Coercion is our reflex.

@sarahg2653 Well, then even Emily, who is pro-life, lied about it on this channel. No, there was no lie. The case was as described. Was some other course possible? No one can claim that; after all, a person can go to court and get a declaratory judgment and pay a lot of money. Maybe they can even get a payday loan, or pawn something. I explained why they did what they did. It's not supposed to be like running a gauntlet. You must have also heard that some states are contemplating laws with literally no exceptions. Perhaps in extremis a doctor can do what he must to save the woman's life, but he has to try to save the embryo/fetus as well. Well, if we agree that the Dems are bad, then ask yourself why they have some new life in their campaign. It's all lies? No it's not.

@sarahg2653 Basically, it's not the doctor I'm worried about. It is these patients, who are relatively rare -- relatively -- and that makes their suffering all the greater. Who gets pregnant at 10, or 12, or 13? Have you ever met anyone? Who has a hopelessly deformed fetus, so severe that they cannot give birth to it normally, and the doctors may even be traumatized by the experience of delivering it? Very, very rare. Imagine what it's like to have to leave your home and your state to find care, and to wonder how you will pay. We are risking traumatizing people to the point where they won't be able to work, or succeed in school, or to take care of existing children, or function normally in the aftermath. I can't imagine it. Taking care of these people does not require no restrictions. There were restrictions under Roe.
