@BDnevernind Wrong. Due Process applies for a whole host of things in addition to criminal law. You cannot have a judgment entered against you if the person suing you cannot prove they SERVED you with all court papers. You cannot be evicted from your apartment, you cannot be expelled from any public school or public university, you cannot be deprived of any right or benefit by any state or the federal government without due process.

@BDnevernind That's no appeal to authority. That's asserting the basis of my knowledge after it was impugned. You could have the very same knowledge by reading the published cases that deal with Due Process, but it's obvious that you haven't, and won't. Stop misinforming people concerning FUNDAMENTAL RIGHTS. That won't cover you in any glory. Becoming a lawyer isn't such a big deal, unless you don't like hard work. Then it can be a problem.

@mrx2062 The dissenting judges on the Colorado Supreme Court also read the Constitution. The US Supreme Court will undoubtedly do so as well.

@BDnevernind I am a lawyer. I plan to read the entire 200+ page opinion. I was just reviewing due process in Chemerinsky and some US Court App 7th Cir. You don't know what you're talking about.

@BDnevernind In any event, the factual predicate for Trump being guilty of "insurrection" has never been tested and confirmed in any court or other proceeding, just as Brie said. That is the process that is due in the event of a criminal charge (or anything like it) being levied against anybody. If Trump had been impeached and convicted, then the clause would (very likely) apply. But so far, he has been acquitted. That may not last.

@mrx2062 Chief Justice Boatright, Justice Samour, and Justice Berkenkotter basically agree that the Colorado election code was designed to provide a summary, expedited procedure to decide simple questions, such as whether a proposed candidate was old enough to be inaugurated president. It cannot be use to make a Fourteenth Amendment, Section 3 determination. Basically, what the other four Justices decided violates Due Process. I think everyone should at least try to read this, to see how technical and abstract these issues REALLY are, and how they don't lend themselves to social media polls, or off-the-cuff MSM comments. You can be sure none of the talking heads, or the "experts" on either side, read the whole case before commenting. They just took sides.
