The statement is always, "we cannot comment on an ongoing investigation/pending lawsuit/etc." Another one: "we'll make our position known in our report/in court/ etc." It has always been necessary to be forthcoming to the public, and thus to justify silence. "I can't answer that" tells you nothing. It could mean, "I don't know."
