Absent a statement under oath, or at least to a state actor (like the police), it is up to the target to sue for defamation -- rarely useful or successful in situations like these. These are considered purely civil matters, and presumed to be protected speech until proven otherwise.

@sphereron Not true. Where do you all get this?? Ordinary defamation is a CIVIL matter. It has to involve incitement to imminent violence, or some other actual threat, or be said directly to a state actor or government agent, or under oath, etc., to be a crime. Just plain defamation is NEVER a crime. Never, ever.

@StarScreamReee No one said that making a false police report, or committing perjury, is generally punished. (We should all know by now that police perjury is often unpunished, for example.) The only point was that simple defamation is not, in general, a crime but a civil offense. Perjury is a crime. Making a false police report is a crime. In a lot of big cities, most murders are unsolved, and therefore unprosecuted -- nevermind perjury, or making false police reports.
