  2. The burden of proof is on the government. They are invoking a law that presumes these people are enemies of our country. They claim they are refugees from criminal gangs. Many of them had applied for asylum and had firm court dates. That's how the authorities knew about them. I think the law can be used to deport. But to use it, you have to present evidence to a court.

It ruled that when a war is declared, it is entirely up to the president to determine whether an enemy alien presents a danger to the country and should be deported. This presumes there is a war, and that the deportee is "an enemy alien." I guess you didn't read the case?
