@jeanwesleynew She claims a trainer in the Marines made that assertion. Without a clip, I can't blame you for not believing her. Still, it makes sense to reserve judgment.

What did Neely do exactly? Was it illegal? "Erratic" is just the subway. Making people fear for their lives or property is generally illegal. Priors are irrelevant in this situation. Someone with no priors could threaten a person. It's wrong the first time. A person with many priors might just have been goofing off and not scaring anyone this time. Thank goodness Penny will have defense witnesses. The court will decide.

Other occasions don't count in this case, except to show how bad the justice system is and how bad mental health care is. But those are not on trial.

@FreefallSC It can be the very first time a person is objectively threatening, and self-defense is justified, even if his prior record was perfect. Or, a person may have a history of threatening others, and no matter how many times he did before, he did not do so this time. Then, given that self-defense is appropriate, there is the issue of proportionality. He also had a history of imitating Michael Jackson on the subway. Which way does that cut? Trick question, it proves nothing about what he did this time.

@FreefallSC Right. How does that contradict what I said? What matters is what he did this time. They will all be under subpoena to testify to what they saw him doing THIS time.
